Blockade of bank accounts after the declaration of consumer bankruptcy

The Polish Financial Supervision Authority (UKNF) investigated the issue of blocking bank accounts in the event of consumer bankruptcy.

The KNF Office examined the banks and observed that they do not apply a uniform practice in this matter. Therefore, he recommended two solutions. Firstly, the current monitoring by banks of the Social and Economic Monitor (and from December 1, 2021, the National Register of Debtors), in which announcements about the declaration of consumer bankruptcy appear. In this way, banks will have up-to-date information authorizing them to block specific accounts. Secondly, the withdrawal of funds from a blocked bank account at the request of the person against whom consumer bankruptcy has been declared should be preceded by appropriate information from the receiver. However, it is possible to depart from this rule in a situation where the bank is able to assess that the funds from a given account are not included in the bankruptcy estate.
