The Gdynia-based loan company has been in the process of accelerated arrangement proceedings since July 2020.
In the case of this procedure, the supervisor is supposed to submit a list of claims and a restructuring plan to the court within two weeks. In the case of Mikrokasa, the inventory and plan still do not exist, although the process has been ongoing for a year and a half. Recently, however, the Gdańsk court took action. It repealed the company’s own management board and dismissed the court supervisor. It also appointed an administrator, thus meeting the demands of the company’s creditors’ attorneys, who had numerous objections to the previous management. Sławomir Bohdziewicz became the new company administrator. He made a decision on re-evaluation of Mikrokasa’s debt portfolio.
The court also decided to appoint the missing member of the creditors’ council. This makes it possible to convene their first meeting. However, the restructuring is still far from being completed. The final debt inventory and restructuring plan will only be prepared after the company’s loan portfolio has been re-evaluated. The court will then be able to order a vote on the arrangement.
